A law that bans AI or deepfakes entirely would violate the First Amendment. If challenged in court, the government could have to show that the law is necessary to prevent specific harm caused by deepfakes and that a ban is the best way to protect against that harm.

Ben Colman, chief executive of image detection startup Reality Defender, thinks there will always be the possibility of detection, even if the conclusion is simply flagging something as possibly fake rather than ever reaching a definitive conclusion.

It's believed the biometric data is used to produce deepfake videos of victims. Combined with stolen credentials, these deepfakes let hackers bypass facial recognition protections on financial apps.

Limit the amount of data available about yourself, especially high-quality photos and videos, that could be used to create a deepfake. You can adjust the settings of social media platforms so that only trusted people can see what you share.
